Terms
Of Service / CONDITIONS OF CONTRACT
Notice of Incorporated Terms-This notice is part of the Conditions
of Contract. Air Transportation is subject to the Carrier's Contract
of Carriage. Terms include, but are not restricted to
(1) Limits on liability for baggage including fragile or perishable
goods. Carrier will not be responsible for money; jewelry;
cameras; video and electronic equipment, including computers
and similar valuables contained in checked or unchecked baggage.
We are in no way liable for goods that are lost, forgotten or
stolen. Your are solely responsible for ensuring the safety of
your personal items.
(2) Carrier reserves the right to refuse carriage to any person
who is not able to produce positive identification.
(3) Claims restrictions, including time periods, in which customers
must file a claim against or sue Carrier.
(4) Carrier's rights to change terms of the Contract.
(5) Rules on reservations, check-in times, refusal to carry,
and smoking.
(6) Our rights and limits of liability for delay or failure to
perform service, which may include schedule changes, rerouting,
and/or substitution of alternate bus / air carriers. You may
inspect the Contract of Carriage at any Carrier's ticket counter.
Refunds and Exchanges-No refunds, or transfers are allowed. Carrier
will provide options for changes. For information regarding these

For the convenience and comfort of our passengers, carry on items
may include: All Laptops, video cases, camera cases, and all
other small electric devices. This may include laptop cases as
well as small brief
cases. Items may be screened per all FAA requirements and regulations.
Allowable personal items may also include magazines, books, diaper
bags, children's small stuffed animals, children's books and
small toys, cell phones, and palm pilots. These carry on items
are not guaranteed, and are at the discretion of Carrier employees
at the terminal and or gate, and in the coach / aircraft. Any
questions pertaining to the above should be directed to our Consumer
Affairs Department, 1-866-OCEANA1.
CHECK-IN:
For travel within the continental United States, all passengers
must arrive at the airport AND/OR coach terminal 1 hours prior
to departure. For travel to and from outside the continental
United States, passengers are required to arrive at the airport
2 hours prior to scheduled departure coach departures 1 1/2 hours.
Later arrivals are subject to cancellations of reserved space,
without compensation.
SCHEDULE CHANGES:
Whenever the Carrier changes the schedule of any
flight or coach departure, the Carrier will transport the passenger
on another of its flights or coaches on which space is available
at no additional charge. No compensation will be given for delays
under 24 hours.
CONDITIONS OF SERVICE
You agree to be bound by these Terms, and to use our
website in strict compliance with all applicable laws,
rulings and regulations, and in a manner that does not
negatively reflect on the goodwill or reputation of Oceana
Tours USA.
1.1 Minors (as defined under the laws of their jurisdiction
or residence) are not eligible to register for, use or
Purchase the Products or Services available on our website.
2.1 You are responsible for keeping the secrecy of
your IATA number and email address login information.
In addition, you will be financially accountable for
all use of our website by you and anyone using your login
information.
Other Limitations
You are not permitted to:
3.1 Use any robot, spider, crawler, other automatic
device or manual process to monitor our content
3.2 Use our website other than to make legitimate reservations
or purchases
3.3 Use our website to make any false, fraudulent
or speculative reservation, or any reservation in anticipation
of demand
3.4 Place false or misleading information on our website,
in your agents area or any in communications between
our staff and yourself.
3.5 Post or transmit any unlawful, threatening, libelous,
indecent, inflammatory, , defamatory, obscene pornographic,
profane material or any material that could constitute
or encourage conduct that would be considered a criminal
offense, give rise to civil liability, or otherwise violate
any law; or for any other purpose that is unlawful or
prohibited by these Terms.
3.6 Upload or transmit to our website, email servers,
or any other part of our system or use any device, software
or routine that contains viruses, Trojan horses, worms,
time bombs, or other computer programming routines and/or
scripts that may damage, interfere or attempt to interfere
with, intercept, the normal operation of our website.
4.1
Oceana Tours USA, in its sole discretion, may, at any
time and without advance warning, notice or liability,
terminate or restrict your access to all or any area
or component of our Site, even if access continues to
be allowed to others users and members. Upon such termination
or suspension, you must immediately discontinue use of
this site. Accessing our website after such termination,
suspension, or discontinuation shall constitute an act
of trespass. Oceana Tours USA shall not be responsible
to you to such suspension or termination.
5.1 Any aspect of ou website may be changed, supplemented,
deleted, updated, discontinued, suspended, or modified
at any time, and without prior notice to you. We may
also, at any time, change or impose fees for certain
services, or establish or change general practices and
limits concerning certain services.
6.1 Oceana Tours USA makes no warranty of any kind
regarding the site, content, products or services, All
of which are provided on an
"as is" basis. Oceana Tours USA expressly disclaim any representation
or warranty that our site will be free from errors, viruses
or other harmful components, that communications to or from
our will be secure and not intercepted, that the Services and
other capabilities offered from our site will be uninterrupted.
7.1 IN NO EVENT WILL OCEANA TOURS USA OR ITS
PARTNERS AND PROVIDERS BE LIABLE TO ANY PARTY FOR ANY
DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES
FOR ANY USE OF THIS SITE, ANY HYPER LINKED WEB SITE,
THE ACTS OR OMISSIONS OF PROVIDERS WHO FURNISH PRODUCTS
OR SERVICES THROUGH THIS SITE, OR THE PRODUCTS OR SERVICES
OFFERED BY PROVIDERS THROUGH THIS SITE, INCLUDING, WITHOUT
LIMITATION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE,
STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR
IS IN ANY WAY CONNECTED WITH(I) ANY USE OF, BROWSING
OR DOWNLOADING OF ANY PART OF OUR SITE OR CONTENT, (II)
ANY FAILURE OR DELAY (INCLUDING WITHOUT LIMITATION THE
USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE
FOR RESERVATIONS OR TICKETING), OR (III) THE PERFORMANCE
OR NON PERFORMANCE BY US OR ANY PROVIDER, OR (IV) ANY
DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE,
ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY
IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION
LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS
TO, ALTERATION OF, OR USE OF RECORD, EVEN IF ORBITZ AND
THE PROVIDER(S) HAVE BEEN ADVISED OF THE POSSIBILITY
OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY.
If, despite the limitation above, Oceana Tours USA
or a partner or provider is found liable for any loss
or damage which arises out of or is in any way connected
with any of the occurrences described in the limitation
above, then Oceana Tours and it's partners' liability
will in no event exceed, in total, the sum of US$200.00
By using any and all parts of our website (including
but not limited to puchasing products and/or services,
signing up as a member) you agree that you have read
and fully understand the terms of services presented
above, including our conditions of service and conditions
